U.S. determination on Tibet atrocities

If enacted, the Secretary of State would have one year from enactment to decide whether acts by PRC officials or agents against Tibetans in Tibet are an ongoing genocide or crimes against humanity. The Secretary would send the written determination to the House Committee on Foreign Affairs and the Senate Committee on Foreign Relations. The Secretary would consider indicators like systematic killing; serious bodily or psychological harm; life conditions meant to destroy a group (forced displacement, mass detention, systemic deprivation); measures to prevent births (including enforced sterilization or coercive abortion); and forced transfer of children (including removal through boarding schools). The Secretary would be able to consult experts, nongovernmental organizations, and members of the Tibetan diaspora. The report would include evidence and documentation, a review of PRC policies to sinicize Tibetan religion and language, findings from the Department of State and credible third parties, and recommendations for U.S. actions such as visa restrictions, sanctions, or diplomatic steps. The report would be submitted in unclassified form but could include a classified annex.
