EPA Lets Texas Refinery Treat Sludge as Non-Hazardous Waste

Published Date: 6/17/2025

Rule

Summary

The EPA says WRB Refining in Texas can treat 7,000 cubic yards of stormwater sludge as non-hazardous waste, so it won’t need special hazardous waste rules. This change means WRB can save money and handle the waste more easily, but they must keep testing to make sure the waste stays safe. This rule kicks in right away and only applies to WRB’s Borger facility.

One-time delist of 7,000 cubic yards

The EPA has approved a one-time delisting allowing WRB Refining’s Borger, Texas facility to exclude 7,000 cubic yards of F037 (petroleum refinery stormwater sludge) solids from hazardous waste regulations. The waste may be disposed of in Subtitle D landfills, the rule is effective immediately, and WRB must follow testing conditions to ensure future-generated waste continues to qualify for the delisting.
