Plan submission required for Part B funds

A State is eligible for assistance under Part B of the Individuals with Disabilities Education Act only if it submits a plan that provides the assurances required by 20 U.S.C. 1412(a). The Annual State Application under Part B (ICR 1820-0030) corresponds with 34 CFR 300.100–176; 300.199; 300.640–645; and 300.705 and requires States to notify the Secretary and local educational agencies of any State-imposed rule, regulation, or policy not required by the Act or Federal regulations.

Removal of disproportionality reporting

State, local, and tribal governments will no longer have to submit the Significant Disproportionality data collection under IDEA section 618(d) and 34 CFR 300.646–300.647 as part of the Annual State Application (Information Collection 1820-0030). The Department estimates 60 annual responses and 840 total annual burden hours for this collection and says removing that data element will reduce respondent burden when completing the application.
