Proposed Rule

Summary

The EPA says the Kentucky part of the Louisville area met the 2015 ozone air quality rules by the August 3, 2024 deadline, thanks in part to some special event exceptions. This means cleaner air for residents and no extra penalties or costly fixes right now. People and businesses in Louisville, KY, can breathe easier knowing the area is on track with air quality goals.

Analyzed Economic Effects

Louisville KY Portion Met Ozone Standard

EPA proposes that the Kentucky portion of the Louisville, KY‑IN area attained the 2015 8‑hour ozone standard by the August 3, 2024 attainment date. The area's 2021–2023 design value is 0.070 parts per million (ppm) after EPA's partial concurrence excluding six wildfire‑influenced days in June 2023, which reduced the design value from 0.072 ppm to 0.070 ppm.

No New Burdens on Small Businesses

EPA certified that this proposed determination is a factual finding and "will not have a significant economic impact on a substantial number of small entities" under the Regulatory Flexibility Act and will not impose new requirements on small entities. The proposed rulemaking does not create new regulatory obligations for businesses.

Opportunity to Comment on Wildfire Data Exclusion

EPA proposes to take final action on LMAPCD's exceptional events request that excluded six days in June 2023 (Canadian wildfire influence) and is asking for public comments on that proposal. You may submit comments identified by Docket ID EPA-R04-OAR-2025-1443 by March 2, 2026; EPA will consider comments before finalizing the action.
