Agriculture and Defense Supply Priority
On February 18, 2026 the President delegated authority under the Defense Production Act to the Secretary of Agriculture to require performance of contracts and to allocate materials, services, and facilities nationwide to ensure an adequate supply of elemental phosphorus and glyphosate-based herbicides. The order notes there is only a single domestic producer and that more than 6,000,000 kilograms of elemental phosphorus are imported annually.
Producer Compliance and Legal Immunity
Domestic producers of elemental phosphorus and glyphosate-based herbicides are required to comply with this order (including the provisions of 7 CFR part 789), and the order confers the legal immunity provided by section 707 of the Defense Production Act for actions taken under the order.
Protection Against Orders That Bankrupt Producers
The Secretary must ensure that any order, rule, or regulation issued under this authority does not place the corporate viability of any domestic producer of elemental phosphorus or glyphosate-based herbicides at risk.
