FRP Compliance Deadline Pushed to 2030

EPA is proposing to move the Facility Response Plan (FRP) compliance deadline from June 1, 2027 to June 1, 2030. Facilities in operation on November 30, 2029 must submit an FRP by June 1, 2030; facilities that meet the criteria after November 30, 2029 have six months to submit; newly constructed facilities that start after June 1, 2030 must submit before starting and may use a 60-day start-up adjustment; planned changes require submission before operations with a 60-day adjustment, and unplanned events require submission within six months. EPA estimates annualized cost savings from the three-year delay of $24.48 million at a 7% discount rate and $18.21 million at a 3% discount rate (2022 dollars), with present value savings of $347.7 million (7%) and $543.0 million (3%).

Climate and EJ Language Removed From Rule

EPA proposes removing references to "climate change" and "environmental justice" from multiple provisions in 40 CFR part 118 (including the definition of "adverse weather" and provisions in 118.5 and 118.11). The rule replaces those phrases with broader language such as "adverse weather conditions" and "potentially exposed or susceptible populations."

EPA Certifies No Significant Small-Biz Impact

Under the Regulatory Flexibility Act, EPA certifies that this proposed delay "will not have a significant economic impact on a substantial number of small entities" because it only delays the compliance date of the CWA hazardous substance FRP regulation finalized in 2024. EPA states the proposed rule imposes no new regulatory burden on small entities.
