EPA Logs New Chemicals: Safety Checks from Fall 2025 Underway

New-chemical filing requirement

If you plan to manufacture or import a chemical that is not on EPA's TSCA Inventory, you must submit a Premanufacture Notice (PMN), Microbial Commercial Activity Notice (MCAN), or Significant New Use Notice (SNUN) to EPA before beginning the activity, as required by TSCA section 5. EPA will review the notice and make a risk determination under TSCA section 5(a)(3).

Public comment deadline set

You can submit public comments on the new chemical submissions listed in this notice by April 9, 2026. Use docket EPA-HQ-OPPT-2025-0067 at https://www.regulations.gov and follow the online instructions; do not submit Confidential Business Information (CBI) through regulations.gov.

EPA posts status and data online

EPA provides periodic status reports and non‑CBI information about TSCA section 5 submissions on its status page and in ChemView at https://www.epa.gov/reviewing-new-chemicals-under-toxic-substances-control-act-tsca/status-pre-manufacture-notices and https://chemview.epa.gov/chemview. You can use these sites to see receipt dates, case numbers, and EPA review status for new chemical submissions.

Test-marketing exemptions (TMEs) allowed

Under TSCA section 5(h)(1), EPA may allow, upon application and under restrictions, the manufacture or processing of a chemical for test‑marketing purposes if the applicant shows the activity will not present an unreasonable risk to health or the environment. TMEs allow limited manufacture/processing for test marketing under EPA-imposed conditions.

Microbial biotech exemption procedures

Premanufacture notification procedures for certain new microbial biotechnology products are established in 40 CFR part 725; these pertain to MCANs and biotechnology exemptions including TSCA experimental release applications (TERAs), TMEs for microorganisms, and Tier I and Tier II exemptions. Submitters of microbial biotechnology products should follow 40 CFR part 725 procedures when applying.
