No Display Panel Drawing Required

If you file a design patent for a computer-generated interface or icon, you no longer must show the display screen or part of it in solid or broken lines in the drawings when both the title and the claim properly identify an article of manufacture (for example, a "computer" or a "computer display screen"). This change is effective March 13, 2026 and applies to applications and proceedings filed before, on, or after March 13, 2026.

Claim Language 'For' Is Sufficient

If your title or claim says an icon or interface is "for" a computer, computer display, or computer system (for example, "icon for display panel" or "projected interface for computer"), the USPTO will treat that wording as adequately describing an article of manufacture and examiners will no longer be instructed to object to such claims under 37 CFR 1.153 or 37 CFR 1.1067. This clarification is effective March 13, 2026 and applies to applications and proceedings filed before, on, or after March 13, 2026.

Design Patents May Cover Projections and Holograms

The USPTO says designs for computer-generated interfaces and icons that are separate from the device that generates them—such as projections, holograms, and other virtual or augmented reality (PHVAR) interfaces—can be eligible for design patent protection when properly disclosed and claimed. This update is effective March 13, 2026 and applies to applications and proceedings filed before, on, or after March 13, 2026.
