Form DS-4076 continues with 4-hour burden

The Department of State plans to keep the DS-4076 form (OMB Control Number 1405-0163) for commodity jurisdiction (CJ) requests. About 300 people a year fill it out, each taking about 4 hours, for a total estimated burden of 1,200 hours per year.

Anyone may submit a CJ (OEM letters usually needed)

The notice says anyone may file a commodity jurisdiction (CJ) request, including people not registered with DDTC. However, the Department generally limits filings to the original equipment manufacturer (OEM) or authorized representatives, and if the OEM is unresponsive you may submit a CJ with a letter explaining why an OEM authorization is not available.

Electronic filing required; mail allowed if unable

Respondents must generally submit Form DS-4076 electronically through DDTC's online system at www.pmddtc.state.gov. If you cannot access the website, you may mail a signed DS-4076 with a brief cover letter explaining your inability to file electronically to the Office of Defense Trade Controls Policy in Washington, DC.

Use tips channel, not CJ, to report violations

The Department says the CJ form is not the right tool for reporting suspected ITAR violations and provides a tips channel instead. To report suspected violations, you may email [email protected] or call (202) 663-2838 between 8 a.m. and 5 p.m. ET; the Department treats tips confidentially and will not discuss its response with the submitter.
