Commission to study Asian Pacific American museum

The law creates an eight-member commission to study a national Asian Pacific American history and culture museum. Two members each are chosen by the Senate majority leader, the Speaker, the Senate minority leader, and the House minority leader. Initial appointments happen within 90 days of enactment. Members must have relevant expertise and a strong commitment to Asian Pacific American history and culture. Federal employees cannot serve. The commission chooses a chair by majority vote, and vacancies do not stop its work and are filled the same way.

Museum study reports and fundraising plan

The commission must study if a national museum can be built and run in Washington, DC. It must report on costs, collections, site criteria with the Smithsonian, effects on existing Asian Pacific American museums, governance, and community engagement. It must decide if the museum should be part of the Smithsonian. It must make a fundraising plan and get an independent review on running the museum without federal money. Reports and the plan are due within 18 months after the commission’s first meeting. The commission may hold a national conference within 18 months of appointments and must send legislative recommendations to the named committees.

Commission ends after final reports

The commission ends 30 days after it submits its final required reports. Its authority and work stop on that date.

Commission runs on private funds only

The commission uses only non-federal money. No federal funds may be used to carry out this law. Members serve without pay but can receive travel per diem. The commission can accept private gifts and hire a director and staff, who are not federal employees. Federal agencies can provide technical help, but cannot detail staff to the commission. The commission is not covered by the Federal Advisory Committee Act.
