  • Voters without documents: People who lack documentary proof would rely on a standardized sworn affidavit or an official verification process the Election Assistance Commission (EAC) must develop. Provisional ballots could still be cast and counted if citizenship is later verified.
  • State agencies and DMVs: Motor vehicle agencies and other voter registration points would be required to collect and record citizenship documents and to notify applicants in advance. The Federal mail registration form would be revised and the EAC must issue guidance within 10 days of enactment.

If enacted, you would need to show U.S. citizenship documents to register to vote in Federal elections. States would not process your registration without that proof, including at DMVs. If you mail the federal form, you would have to bring proof in person by your state’s deadline, or on Election Day in states with same-day registration. If you lack documents, you could use a sworn affidavit and an official verification process. People with disabilities would get reasonable help. You could cast a provisional ballot, and it would count if you are later verified as a U.S. citizen.

States must check voter rolls for citizenship

If enacted, each state would have 30 days to start a program to find noncitizens on voter rolls. States would use DHS, Social Security, and state ID data to check citizenship. Federal agencies would have to share requested data within 24 hours and could not charge fees. States would remove people found not to be citizens, and DHS would investigate and may start removal cases. DHS would also tell states when someone becomes a citizen.

Limits on using DMV voter data

If enacted, information from DMV or NVRA voter registration would usually be off-limits in criminal or immigration cases. It could be used only if the applicant knowingly tried to register and knowingly lied under oath about being eligible.

Faster changes to voter registration forms

If enacted, voter registration forms and materials could be changed without going through the federal Paperwork Reduction Act. This would likely speed updates to forms under this bill.
