Small Cemetery Conveyance Act

Free federal cemetery land transfers

If enacted, the bill would let the Secretary convey federal parcels used or once used as cemeteries without payment. Eligible recipients would be State or local governments, Indian Tribes, or certain New Mexico land grants with a historic claim. Parcels would be limited to 40 acres or less, and one adjacent acre could be included. The land would have to stay used for cemetery operations or it could revert to the United States. The Secretary would be able to waive some section 4 conveyance cost rules if a demonstrated need exists. The bill would also remove cemeteries from an older Small Tract Act category so all cemetery transfers follow this new rule.
