National employer notification service

This bill would require the Transportation Department (FMCSA) to issue a final rule within 1 year to set up a national employer notification service. States would have up to 2 years after that rule to start using the service to send employers reports about CDL drivers' license or record changes. Reports would cover moving-violation convictions, failures to appear, accidents, license suspensions or revocations, and other actions against driving privileges. The rule would require school-bus employers to join, treat schools and private contractors as employers, and allow States to use CDL grant funds to pay for implementation.

CDL drivers get copy of reports

This bill would require that when the national employer notification service gives an employer a report about a CDL employee, the employee would receive simultaneous notification and a copy of that report. That requirement would be part of the FMCSA final regulation setting up the service.

Employers exempt from annual driving checks

This bill would ensure employers who participate in the national employer notification service are exempt from the annual driving-record inquiry and review required under current federal rules (49 CFR part 391.25). Employers must participate in the notification service to get the exemption. FMCSA guidance cited in the Federal Register (vol. 80, p. 13069) would guide implementation.
