Sexual assault victims get kit tracking rights
Alaska law gives victims the right to notice of their sexual assault examination kit’s location and testing date. The Department of Public Safety must track kits from collection through testing, with providers, police, and labs entering required information. Victims can check tracking information and choose automatic updates. The system is confidential and not a public record, though tracking information may appear in the department’s report. Health care providers must notify police within 14 days after using a kit. Police must send it to an accredited lab within 20 days after receiving notice or using the kit. Labs must test kits within 120 days of receipt and make reasonable efforts to notify victims within two weeks afterward. The handling and testing deadlines do not apply if the case is resolved before testing. Missing a deadline does not require dismissing a criminal case or prevent the evidence from being used.
