Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 1 costs, 2 mixed.

New eligibility rules for farm tax breaks

Beginning February 1, 2027, farm-use property assessment covers crops, fruits, flowers, livestock, other agricultural products, and grazing. Owners or lessees must sell at least $2,500 of products produced from the land during the tax year. Adjoining land qualifies through an approved soil conservation plan supporting qualifying farm production. Land used for marijuana production does not qualify. Filing IRS Schedule F is no longer an eligibility condition, but applicants still must give farm-income information to local assessors.

Residents lose votes on new service areas

Beginning July 1, 2026, second-class boroughs can change certain local service areas without voter approval. This applies to service areas created on or after that date. Boroughs can abolish, replace, alter, or combine those areas without the usual required vote. The change does not set a household payment or benefit.

Farm tax paperwork grows with filing relief

Beginning February 1, 2027, farm-use applicants must apply annually by May 15 and give local assessors Schedule F information. Applicants required to file Schedule F with the IRS must provide a copy; S corporations provide equivalent information. Leased land requires a lease signed by both parties covering the assessment period. These documentation rules exclude people with interests in land classified or restricted by the state for agricultural use. Owners with no farm-income history can declare their intended farm use and promise to file Schedule F for that year. S corporations using this process do not need that promise. By April 15 of the following year, these owners must submit Schedule F, and S corporations must submit equivalent information. Missing that deadline forfeits the farm-use exemption.
