Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Alaska patients gain health record privacy controls

Alaska's exchange operator must protect information that identifies patients and follow the strictest applicable state or federal privacy law. It must keep a secure, traceable electronic record of access. Identifying information can be released only for treatment, payment, limited participant health care operations, public health activities, or patient-authorized uses. Marketing is prohibited. Patients with records in the exchange can opt out, receive notice of privacy violations, and request reports showing record access. The operator must also provide procedures for patients to approve sharing when privacy and security laws require additional permission.

Alaska builds a statewide health records exchange

The law takes effect immediately and requires Alaska's Department of Health to establish a statewide electronic health records exchange. The system must work with other systems and follow state and federal rules for exchanging health data. The commissioner selects one or more qualified Alaska groups to implement and operate it; private for-profit or nonprofit groups can qualify. The operator must support record connections, installation, training, continued use, better work processes, quality improvement, and ongoing evaluation. Its advisory or governing body includes the commissioner and nine representatives: hospitals and nursing facilities, private medical providers, community primary care providers, federal providers, tribal health organizations, insurers, consumers, employers or businesses, and behavioral health providers. It also includes two nonvoting University of Alaska Board of Regents liaisons and at least one additional nonvoting stakeholder liaison. The operator must involve stakeholders, provide technical help, follow state nondiscrimination and conflict-of-interest policies, and submit an annual budget for governing-body approval. It must provide infrastructure cost estimates and report cost and savings data to the department. An annual report to the Legislature is due December 31, covering participation, records exchanged, barriers including connectivity, and recommendations for lasting participation and state funding. The statewide system excludes participants' own technology, software, and information.

Alaska health exchange uses funding and fees

Alaska's health department must help apply for available federal money to plan and build the health records exchange. The department and exchange operator can seek and accept available funding and equipment. The department can also make contracts and adopt rules needed to carry out the law. The system must become self-supporting through user fees and other public and private funding. Fees can apply to the department or other government entities; the law sets no fee amount or required patient charge.
