Beginning June 1, 2025, Calhoun County can adopt resolutions regulating halfway houses, substance abuse treatment centers, and sober living homes. Cities and towns in the county have the same power within their borders. Other facilities are covered when they house anyone placed by court order or supervised by the Calhoun County Community Punishment and Corrections Authority, Inc. Local rules can require permits and limit facility size, location, distance from specified places, and tenants per room. Fines can reach $1,000 per day, per resident, for each violation, but require notice and a hearing first. Local governments can enforce their rules against facility owners in the Civil Division of the Calhoun County Circuit Court. Any adopted resolution must bar registered sex offenders from facilities housing anyone placed by court order or supervised by that authority. The law is repealed June 1, 2028.
