Beginning October 1, 2025, parties harmed by final Alabama municipal zoning board decisions can appeal to circuit court. They must first file written notice with the board within 15 days after its final decision. They must then file in the circuit court for the county where the board meets within 45 days after that decision. They must also serve the board with the appeal at the city clerk’s office. Within 45 days after service, the board must send certified meeting minutes and documents submitted during the meeting to the court. Only the court can extend that deadline. The court hears the case anew, and appellants pay for any certified written transcript they request. The board’s decision stays in effect unless the court grants a pause, called a stay. The court must weigh the applicant’s chance of winning, harm that cannot be repaired without a stay, substantial harm to any party, and the public interest.
