Beginning September 1, 2025, Elmore County adds a tax on personal-property rentals covered by Alabama’s rental tax. This tax is in addition to other taxes, but excludes rentals of motor vehicles that require state registration. To calculate the rate, start with 9.5% and subtract the lower of the general state rental-tax rate or 4%. In cities, towns, and their police jurisdictions, also subtract the applicable municipal rental-tax rate. No county tax applies there if the result is negative. In unincorporated areas outside police jurisdictions, use the greater of 5.5% or the starting calculation without a municipal subtraction. Rates are rounded to the nearest tenth of a percent. The county revenue commissioner must calculate and publish initial rates by August 1, 2025, and publish adjustments when referenced rates change. The county commission must approve final rates by resolution and set rules for collecting and administering the tax.
The law takes effect June 1, 2025, with rental-tax collections beginning September 1, 2025. Elmore County must deposit the proceeds into the Enhance Elmore Fund. The county commission must allocate 90% for infrastructure and 10% for economic development. The law does not state total funding or provide direct household payments.
