Marion County sheriff gets contracting options

Beginning October 1, 2025, the Marion County sheriff may contract with private, public, or government entities to serve court documents. These contracts cannot cover arrest warrants. The law allows contracts but does not require them or guarantee changes in service or cost.

New $50 fee for Marion County cases

Beginning October 1, 2025, Marion County adds a $50 fee per case for each party needing personal service by the sheriff. The fee covers civil and criminal cases in district and circuit courts and comes on top of existing charges. The district attorney and grand juries are exempt. Court officials must collect the fee and deposit it into the new Marion County Service of Process Fund. The fund sits in the county treasury, with separate accounting and state audits alongside other county accounts. The county commission may spend this money for any lawful purpose. This revenue cannot reduce or replace other income for the county or its subdivisions.
