Beginning October 1, 2025, active manufacturer warranties on installed heating, ventilation, and air conditioning systems automatically transfer to new homeowners. Both the home sale and the warranty agreement’s start or renewal must occur on or after that date. Covered homes include single-family houses, duplexes, triplexes, quadraplexes, and individually owned condo or cooperative units. The rule covers the original base warranty for repairing, servicing, or replacing system parts, not coverage beyond that term. The warranty provider must honor coverage as though the buyer were the original purchaser, without charging a transfer fee. The transfer does not extend the warranty’s remaining term. Earlier warranty agreements remain governed by the law in effect when they began or were renewed.
