3 provisions identified: 1 benefits, 1 costs, 1 mixed.
Public education employees no longer need an injury to stop them from working to qualify for injury compensation. The injury must arise from employment, happen while performing duties, or occur on employer property at the employer’s direction or request. Mental injuries are covered only when a physical bodily injury produces or directly causes them.
Alabama creates an injury compensation program, trust fund, and governing board for covered full-time public education employees. The Board sets and publishes the start date, no later than October 1, 2026. The program is the only remedy for injuries on or after that date; earlier injuries stay with the Board of Adjustment. Employees covered by the new law cannot use the Board of Adjustment route for unreimbursed work-injury medical costs. Program and administrative spending are limited to yearly funding approved by lawmakers.
Public education employees must give written injury notice within five working days after the injury. Notice goes to an immediate supervisor, executive officer, or school principal, if applicable. If the employee dies or is medically unable to report, someone with reasonable knowledge can notify the employer within 30 days.
