The law takes effect immediately and sets special rules for affected Alabama State Senate races in 2026. These rules apply when a federal court judgment or lifted injunction allows the district boundaries from Act 2021-558 to return. If that happens too late for the regular primary schedule, Alabama must hold a special primary for affected districts. The results must be certified by August 26, 2026. The Governor must promptly call the election and set dates that follow federal law. The special primary is required even if a regular primary already occurred. The top vote-getter becomes the party nominee, with no runoff. Regular-primary results and nominee certifications no longer count for affected offices; special-primary results alone determine those nominees. Candidates qualified for the regular primary remain eligible, subject to applicable laws and party rules consistent with state election law. Parties can instead choose nominees through another lawful method, but must certify them to the Secretary of State by August 26, 2026. Regular primary timing stays unchanged where these boundary changes do not occur, and the 2026 General Election date stays unchanged.
