Private sewer systems can choose state oversight

Beginning October 1, 2025, eligible private sewer and wastewater systems can choose Alabama Public Service Commission oversight by filing notice. They must share ownership or control with a private system already under Commission rate oversight on that date. The joining system must not already be under Commission oversight on that date. Shared control includes at least 50% of voting shares or voting equity, general-partner status, or control over choosing most governing members. The Commission must certify and regulate joining systems. Existing rates stay in place until new Commission-approved rates take effect. Future rates generally combine both systems’ capital and operating costs into one rate structure for all customers. Adjustments are allowed for existing obligations or circumstances specific to an area. Property valuation considers original cost, reproduction cost when original cost is unavailable, and other legally recognized factors. Joining systems must pay Commission wastewater management fees; the law sets no fee amount or direct household charge. Customer bills are not guaranteed to rise or fall. Local constitutional amendments can limit the law’s reach, and Jefferson County Board of Health authority remains intact.
