Private auditors hired by Alabama counties or cities must include an official notice when writing businesses about license or privilege taxes. The notice must confirm their authority to collect taxes for that local government. Businesses can sue private collectors that skip the notice or knowingly try to collect taxes not legally owed. This right to sue does not extend to the local government, its officials, employees, or related public bodies.
Businesses can bring local business license and privilege tax disputes, including covered county and city license fees, to the Alabama Tax Tribunal. Beginning October 1, 2025, the Chief Judge prepares an annual budget. The Legislature funds Tribunal operations each year from the Revenue Department Administrative Fund, exclusively for Tribunal operations. The law also specifies a $425,000 transfer for the fiscal year beginning October 1, 2014, in four equal quarterly payments.
Alabama counties and cities charging business license or privilege taxes must report to the Department of Revenue annually by March 30. Reports list the previous fiscal year’s tax classifications and schedules, changes that year, and planned changes for the next year. The department must publish the reports. Local governments that miss the requirement must hold later receipts from these taxes in escrow until they comply.
