Beginning July 1, 2025, eligible Alabama state, local education agency, and community college system employees get paid parental leave. Employees need 12 consecutive months of employment immediately before the event, which must occur on or after that date. For birth, stillbirth, or miscarriage, female employees get eight weeks and male employees get two weeks. The law defines miscarriage as loss after 12 weeks of pregnancy and stillbirth as loss after 20 weeks. Adoption placement qualifies for eight weeks when the child is age three or younger; jointly adopting eligible parents receive eight and two weeks. Pay stays at 100% of base pay without using sick, annual, or other leave. Employees must submit a written leave plan and agree to stay employed for at least eight weeks after related leave ends. Agencies may waive the return requirement for serious health circumstances; failure to comply can lead to repayment through offsets. Emergency paperwork is due as soon as practical after the emergency ends. Leave covers only one qualifying event per 365 days and must end within 365 days of the event or leave's start, whichever comes sooner. Split or reduced-schedule leave is allowed, but bonding schedules require advance agency agreement, and birth or adoption leave requires a continuing parental role. Leave runs alongside applicable state leave and federal family and medical leave, rather than adding to those leave periods. Employers keep paying their health coverage share; employees keep paying theirs. Employees return to the same or an equivalent job with equivalent pay, benefits, seniority, status, and terms. Local education agency employees return to their prior teaching grade unless they agree otherwise. Unused leave has no cash, retirement, or rollover value. Implementing agencies must use forms and procedures that are not unduly burdensome and provide written leave-rights notices at hiring. They must publish annual reports covering the prior fiscal year by October 1, 2026, and each October 1 through 2030.
Beginning July 1, 2025, Alabama state employees can no longer receive donated leave for family or adoption leave. Donations of unused annual, sick, or compensatory leave remain available for employees who qualify for catastrophic sick leave. The donor's appointing authority must approve; State Personnel Board approval is also required when the donor's pay grade is lower. The recipient's appointing authority may limit hours per catastrophic illness. Receiving more than 480 donated hours during a state career requires State Personnel Board approval.
