3 provisions identified: 1 benefits, 0 costs, 2 mixed.
Beginning October 1, 2025, Kinston camera speeding findings cannot appear on criminal or driving records. They do not count as convictions or moving violations and cannot increase punishment for a later crime. Insurers cannot use these findings to set rates unless an accident happened because of the violation. The law limits their use as evidence of negligence or other blame, subject to evidence rules. No one can be arrested or jailed for not paying the civil fine or late fee.
Beginning October 1, 2025, Kinston can adopt an ordinance allowing speeding cameras within town limits. Tickets apply only to speeds more than 10 miles per hour above the applicable limit. The fine is capped at $100, plus authorized court costs and a $10 state recordkeeping charge. The ordinance can add a late fee up to $25; unpaid fines and costs can become court judgment liens. Before use, the town must run a public awareness campaign at least 30 days in advance. Signs must appear at five or more roadway entrances and within 60 yards of each device. Technician pay cannot depend on ticket counts or fine collections. The town cannot impose this civil penalty for the same event when an officer makes a qualifying arrest or citation.
Beginning October 1, 2025, recipients can contest Kinston camera tickets in municipal court. The town must send certified-mail notice within 30 days of the violation, including images, charges, and payment and hearing instructions. Notice is presumed received on the 10th day after mailing; payment is due 30 days after that day unless contested. A written hearing request is due within 15 days after that 10th day. A late request requires an affidavit stating actual receipt and a request within 15 days of actual receipt. Missing payment and hearing deadlines counts as admitting liability. The town must prove its case; defenses include not owning the vehicle, qualifying theft, emergency operation, or following an officer's direction. A finding or missed hearing generally requires payment within 10 days after judgment. An appeal to Coffee County Circuit Court is due within 14 days and pauses fine enforcement pending a new trial. Losing an appeal adds Circuit Court costs; being cleared means no municipal court costs are owed.
