Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Property owners elect development district boards

Beginning October 1, 2025, founding documents for districts defined in Section 35-8B-1(s) must name three people as board members. The district's real property owners elect board members by majority vote. Each member serves a four-year term or until a successor is elected.

Gambling banned in certain development districts

Beginning October 1, 2025, property in districts defined in Section 35-8B-1(s) cannot be used as a casino site. Commercial and charitable gambling are also banned on that property.

Cities can annex certain development districts

Beginning October 1, 2025, cities allowing alcohol sales can annex property in districts defined in Section 35-8B-1(s). The city must be in the same county, but the property need not touch city limits. The district board must petition, and the city must approve; both may agree on conditions. A map must reach the county probate judge at least 30 days before approval. Annexation must begin by June 1, 2026. After annexation, the county keeps the right—but not a duty—to provide environmental services, including garbage collection.
