City courts handle scrap tire misdemeanors

Beginning June 1, 2025, municipal courts in Alabama Class 2 municipalities have authority to hear scrap tire law violations. For people convicted there, specified misdemeanor penalties replace the penalties otherwise provided by state scrap tire law. Illegal scrap tire accumulation is a Class C misdemeanor, and illegal processing is a Class B misdemeanor. Illegal transportation is a Class A misdemeanor.

Local governments can enforce scrap tire rules

Beginning June 1, 2025, Alabama counties and Class 2 municipalities can seek lead responsibility for local scrap tire enforcement. They must enter an agreement with the Alabama Department of Environmental Management, which must set delegation procedures by rule. Participating governments must investigate all scrap tire reports and complaints, including illegal dumping, and review businesses' scrap tire shipment records. They must report all quarterly scrap tire activities to the department using its form. They must also send a written investigation report within 10 days after an initial investigation.
