Continued funding for cemetery care

Beginning July 1, 2026, the law carries forward up to $101,000 from the Development and Enhancement Fund. This continues earlier funding for cemetery care through the Department of Commerce's State Insurance Department. Upkeep money supports insolvent, licensed perpetual-care cemeteries in court-ordered receivership or conservatorship for at least five years. Buying these cemeteries is also covered, with acquisition costs capped at $1,000 plus necessary purchase costs. Historic perpetual-care cemetery grants can go to nonprofit or government owners, or nonprofits caring for or improving these cemeteries. Contracts and obligations cannot exceed money actually available in the State Treasury. Grants, donations, federal funds, and other uncommitted cash or funds can supplement the state money. The department cannot use its Maintenance and General Operations funding for these purposes. Spending must follow the law's stated purposes and applicable state purchasing, accounting, budget, and fiscal-control rules.
