Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Nuclear projects qualify for clean energy programs

Colorado’s county clean-energy programs now recognize nuclear energy and hydrogen made from nuclear energy. Utilities can count nuclear toward carbon pollution goals under the expanded definition covering electricity generation and storage without carbon dioxide emissions. Both definitions include nuclear projects funded through the U.S. Department of Energy’s Advanced Nuclear Reactor Programs. The law takes effect at 12:01 a.m. the day after the 90-day period following final adjournment of the 2025 legislative session, unless a referendum petition is filed. If referred and approved by voters in November 2026, it takes effect upon the governor’s official declaration of the vote.

Nuclear facilities excluded from clean-energy tax treatment

Colorado excludes nuclear energy from the clean-energy resource definition used in this property-tax rule. Nuclear facilities do not gain the clean-energy property-tax treatment available under that rule. The law does not specify a resulting tax amount.
