Insurance covers child seat replacement for families

Colorado auto insurers must cover replacement costs for child restraints that were in a vehicle during a covered accident. When an accident claim is filed, insurers must ask whether a child restraint was in the vehicle. The insurer must pay for a replacement or reimburse the claimant; the law sets no specific dollar limit. The scheduled start date is January 1, 2026. Both the policy’s issue or renewal date and the claim’s filing date must fall on or after the effective date. A referendum petition filed within 90 days after the legislature’s final adjournment delays the challenged provisions. Those provisions then require voter approval at the November 2026 general election and take effect upon the governor’s official vote declaration.
