Insurers must send annual, plain-language notices when wildfire scores or prevention discounts affect pricing or coverage decisions. Notices explain the score range, your position, property features behind the score, and how each prevention action affects it. They must also explain that insurers can use different models and score ranges. Applicants receive scores within 15 days after a completed application; policyholders receive them at renewal or with a nonrenewal notice. After property prevention work or proof of community protection since the last application or renewal, policyholders can request updated scores. Insurers must provide those scores within 30 days. Applicants and policyholders can appeal inaccurate scores, classifications, or discounts by providing evidence of property or community prevention work. Insurers must give written appeal instructions, acknowledge appeals within 10 calendar days, and issue written decisions within 30 calendar days. After a denial, the insurer must send the appeal and response to Colorado's insurance commissioner upon request. These rights cover home, condo-unit, and multifamily policies, including FAIR Plan coverage, issued or renewed beginning July 1, 2026. A referendum petition filed within 90 days after final adjournment delays the start until November 2026 voter approval and the governor's declaration.
Insurers using wildfire or catastrophe models must account for property and community wildfire prevention in their models or otherwise in pricing and coverage decisions. If their models do not include this work, they must give discounts for verified property work or nearby community protection. The law sets no discount amount or guaranteed savings for households whose prevention work is included in models. Insurers must publicly post qualifying actions, discount amounts, other premium adjustments, and wildfire score appeal instructions. These rules cover Colorado home, condo-unit, and multifamily policies, including FAIR Plan coverage, issued or renewed beginning July 1, 2026. A referendum petition filed within 90 days after final adjournment delays the start. In that case, the law takes effect only after November 2026 voter approval and the governor's declaration.
Insurers using wildfire models, catastrophe models, or risk-scoring methods must submit them in complete rate filings to Colorado insurance regulators. Filings must explain rate effects, support pricing factors and prevention discounts with insurance calculations, and describe use in coverage decisions. As data is available and rules require, filings must explain whether and how models account for statewide wildfire prevention. This includes forest treatment, firefighting and prevention equipment, and utility wildfire work approved under a Public Utilities Commission plan. Submitted models are protected as trade secrets and are not available through Colorado's public-records law. The insurance commissioner can adopt rules to carry out the law. The requirements cover home, condo-unit, and multifamily policies, including FAIR Plan coverage, issued or renewed beginning July 1, 2026. A referendum petition filed within 90 days after final adjournment delays the start until November 2026 voter approval and the governor's declaration.
