Colorado studies field drug test harms

The law creates a 16-member group to study color-changing field drug tests in criminal cases, jails, and prisons. It must examine harms such as unjust detention, pressured guilty pleas, and wrongful convictions. Its work depends on an approved nonprofit contract. Members must be appointed by July 1, 2025, and meet three times by video starting that July. State entities must provide requested help consistent with their duties and the law, including existing test-use information and policies. By December 1, 2025, the group must finish its work and report to the House and Senate Judiciary Committees. It must recommend ways to prevent test-related harms and related consequences, but cannot draft bills. Members receive no pay but may receive reimbursement for service expenses; no amount or repayment is guaranteed. The law ends the program on July 1, 2026.

Nonprofit covers drug test study costs

The Legislative Council director must seek proposals and contract with a nonprofit by September 1, 2025, subject to Executive Committee approval. Without a contract and nonprofit designation, none of the working-group requirements must take place. The nonprofit must cover its contracted service, staffing, and meeting-support costs, but may accept cash or in-kind gifts, grants, and donations. The law states an intent not to use General Fund money for the nonprofit contract. Separately, it provides $1,008 from the General Fund to the Legislative Department for the General Assembly's implementation costs in 2025–26.
