Doctor choice protections for injured workers

Colorado residents with work injuries can choose a state-licensed, Level I or Level II accredited treating doctor. The doctor must be within 70 miles of home or work. The limit extends to 100 miles if three or fewer qualified doctors within 70 miles will provide treatment. Employers or insurers must give verified written notice of this right within 7 business days after receiving injury notice. Workers choose in writing on the director's form before maximum medical improvement. If workers do not choose within 7 business days after receiving that notice, the employer or insurer can choose. Workers retain the right to make a later choice before maximum medical improvement. For nonresidents, employers or insurers must choose as soon as possible, within 10 business days after injury notice. That doctor must be within 100 miles of home; workers can choose if the deadline is missed. Any capable doctor or facility can provide emergency care; the choice process applies afterward. Insurers must give written advice about choosing again if a doctor refuses care or discharges the worker for nonmedical reasons, further care is needed, and no other authorized doctor is willing. Workers' attorneys cannot refer clients to authorized doctors or practices in which they hold an ownership or other financial interest.

More doctor options for injured workers

Injured workers get one doctor change within 120 days after the first doctor designation, instead of 90 days after injury. Workers must give written notice on the director's form before maximum medical improvement. The replacement must be state-licensed and Level I or Level II accredited, and the transfer cannot threaten health or safety. The prior doctor sends relevant records and continues primary care until the first visit with the new doctor. Existing work restrictions stay in place until expressly changed. Workers can also request care from a personal doctor or chiropractor using the director's form. Employers or insurers must serve a written approval or denial on the required form within 20 days after the request's certificate-of-service date. Missing that deadline waives their objections; it does not automatically approve the request. Approved care is paid under the workers' compensation fee schedule.

Payment protections for injured workers' care

Employers and insurers must follow state treatment-review standards when responding to a treating doctor's request for approval. If they fail, the director can deem an authorized doctor's services approved, reasonable, and necessary, and require payment. Workers also get reasonable costs back when a hearing application concerns an unpaid, disputed medical benefit recommended by an authorized doctor. The court must award those costs if the benefit is admitted fewer than 20 days before the hearing. The same rule applies if the benefit is ordered after the hearing application is filed. Attorney fees are excluded.
