Clearer care rights for eligible Colorado residents

Colorado clarifies who qualifies for direct-care protections: people eligible under specified programs or other qualifying home- and community-based services waivers. The listed programs are parts 3, 4, 6, 7, 9, 11, 12, 13, and 19 of article 6, title 25.5. Other waivers qualify when Colorado's Department of Health Care Policy and Financing holds federal waiver authority. Participants directing their care under part 11 retain control over hiring, firing, scheduling, and worker wages, within legal limits. The direct-care board must give these participants its sample notice in an accessible format. Eligible participants can also serve as employer representatives on that board. Professionals otherwise barred from serving as guardians can serve when a court finds good cause. Exceptions also cover family caregivers defined by law and caregivers to an eligible person.

Fewer services qualify for direct-care protections

The law narrows which services count as direct care under these rules. Services must fall under parts 3, 4, 6, 7, 9, 11, 12, 13, or 19 of article 6, title 25.5. Services under parts 5, 8, and 10 no longer count. The service also must not require its provider to hold a state or federal license or certification.
