Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 0 costs, 3 mixed.

Full burn payments limit future claims

Claimants accepting payment for the full certified loss must give up future claims related to that prescribed burn. The waiver protects the burn manager, helpers, funders, and the landowner on whose behalf the burn occurred. Claims against other parties remain allowed, but claimants cannot recover the same losses twice. The law also preserves insurance claims for losses from burns not certified under this claims process.

Burn loss payments require advance fees

Colorado creates a prescribed fire claims fund with a required $1 million transfer; payments depend on annual funding approval. Claims must document firefighting costs or other losses caused by a prescribed burn that followed applicable laws and standards. Losses generally must occur within 60 days after the burn ends, with rule-based exceptions for lingering fires and unique fire characteristics. Before burning, the certified manager must register the written burn plan and pay at least $100, with higher fees allowed for complex burns. Total payments for claims from one burn cannot exceed 10% of the fund balance when the claim is filed.

Certified burners gain another Colorado pathway

Burners certified by another state or entity can qualify for Colorado certification without completing Colorado's training and certification program. They must apply under division rules, show proof of valid certification, and pay any required fee. They must also obtain a valid Colorado certification number.
