Active firearm waivers carry purchase attempt fines

People with an active firearm purchase waiver may not try to buy a firearm. Each attempt is a civil infraction carrying a fine of up to $25; the criminal attempt law does not apply. Firearm dealers must report transfers they know violate the waiver rule to law enforcement.

Colorado residents can block their firearm purchases

The law creates a voluntary program to block firearm transfers to people who sign up in Colorado. The Department of Public Safety cannot implement it until it receives $200,000 in gifts, grants, or donations for the online portal. The portal must support filing waivers, updating contact details, and requesting cancellation. The Colorado Bureau of Investigation must verify identity before accepting a waiver or cancellation request. It must deny transfers while a waiver is active and enter accepted waivers into background-check systems within 24 hours. The bureau must immediately notify the filer and chosen contacts when it accepts a waiver. Chosen contacts also receive notice within 24 hours of a denied transfer or receipt of a cancellation request. The block continues for 30 days after the bureau accepts cancellation. Afterward, the bureau must remove background-check entries and destroy waiver records, provided the person is otherwise legally eligible to possess firearms. Waiver records are confidential, with disclosure limited to legally allowed uses or court orders. Starting in state fiscal year 2026–27, lawmakers may provide General Fund money for the portal.
