Qualifying farm buildings avoid energy reporting

The law exempts qualifying agricultural buildings from Colorado's covered-building energy-use data collection and reporting requirements. These buildings or structures house farm equipment, hay, unprocessed grain, poultry, livestock, or other agricultural products or inputs. The act takes effect at 12:01 a.m. the day after the 90-day period following the legislature's final adjournment. A referendum petition filed during that period delays the act unless voters approve it at the November 2026 general election. With voter approval, it takes effect on the date of the governor's official declaration of the vote.

Some farm buildings lose reporting exemption

Using more than half of a building's gross floor area for agriculture no longer automatically exempts it from energy reporting. Buildings that do not meet the new agricultural-building definition can face Colorado's covered-building energy-use collection and reporting requirements. Reporting is required only when the building otherwise qualifies as a covered building.
