Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Protecting providers’ access to discounted drugs

Colorado protects providers’ access to discounted drugs through the federal 340B program, including delivery to contracted pharmacies and authorized locations. Drug makers, third-party logistics providers, repackagers, and their agents and affiliates cannot block or limit access. Exceptions apply when federal health officials prohibit receipt or federal law requires limited distribution. Manufacturers cannot demand health, claims, purchasing, payment, or other data unrelated to a federal health program claim. Voluntary sharing and federally required data, including authorized audit records, remain allowed. The attorney general can enforce violations under state consumer protection law, with civil penalties and damages; each drug package counts separately. The pharmacy board can also discipline regulated parties.

Hospitals face limits on drug savings

Colorado hospitals covered by the reporting rules must report annual 340B drug savings and explain how they use them. Reports include combined market-rate and purchase costs for those drugs, total hospital operating costs, and charity-care costs. Records protected under state public-records law remain protected. These hospitals cannot use 340B savings to cover more than 35% of their board’s total annual compensation or expense reimbursement. Savings also cannot pay hospital tax penalties or fines, lobbying or ballot-measure influence, promotional advertising or public relations, gifts, or entertainment. Board and officer travel, lodging, food, and beverages are also barred uses. The advertising ban excludes legally required messages and essential patient safety and information communications. The law does not require hospitals to redirect the money to a specific purpose.
