Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 0 costs, 2 mixed.

Courts must weigh abuse in spousal support

Colorado courts must consider abuse by either spouse when setting the amount or length of spousal support. Covered conduct includes domestic violence, coercive control, economic abuse, litigation abuse, emotional or physical abuse, and unlawful sexual behavior. Economic abuse includes controlling money or credit, blocking school or work, withholding basic needs, and threatening to expose immigration status. The law also adds tax treatment to the factors courts consider, but provides no formula linking abuse to support payments. The law makes these changes subject to voter approval.

Divorce filers must disclose protection orders

People filing for divorce or legal separation in Colorado must disclose covered restraining, civil protection, and emergency protection orders. This covers orders entered during the five years before filing against either spouse when the other spouse was protected. Filers must provide the order’s subject, case number, and issuing jurisdiction. This gives courts information about prior protection orders but adds a disclosure duty for filers. The law makes these changes subject to voter approval.
