Colorado local governments can enforce adopted wildfire codes through their own rules or an agreement with another entity. Covered properties must comply by the local deadline or three months after code adoption, whichever comes first. A local government lacking enforcement rules or an agreement can request state fire division inspections and enforcement. The division can charge property owners a reasonable fee; the law sets no amount. Those fees and civil penalties collected under the division’s procedures go to the Code Board Cash Fund.
Covered Colorado local governments have nine months, up from three, to adopt wildfire codes meeting or exceeding state board standards. They must cooperate and provide requested information when the board reviews their codes or how they apply them. Local governments can ask the board for code changes within their area and appeal a denial. Approved changes apply only there and expire on the date set by the board. Local governments must ask before expiration to keep a change, unless the board extends it and sets a new end date.
