Bill Overview

Analyzed Economic Effects

4 provisions identified: 2 benefits, 1 costs, 1 mixed.

Some farm business owners lose reimbursement

Covered claimants cannot get bond or irrevocable letter-of-credit reimbursement if they meet a 5% voting-share ownership test when filing. The test covers ownership in the licensed business whose failure caused the claim, or its parent company. Patronage, membership, and partnership interests, plus publicly traded shares, do not count toward the test. Patronage interests are cooperative ownership shares distributed to producers based on their business with the cooperative.

Small farm buyers get higher purchase limit

The yearly purchase limit for small-volume dealers rises from less than $20,000 to less than $45,000. It covers total farm products or commodities bought from owners for processing or resale. Licensed small-volume dealers face a class 2 misdemeanor for buying $45,000 or more in farm products from owners yearly. This purchase ban now starts at the higher limit. The agriculture commissioner can periodically adjust both limits by rule.

Marijuana excluded from farm commodity rules

The law explicitly excludes marijuana from its definition of a commodity. Marijuana is outside this act's commodity licensing and oversight rules.

Farm trade oversight continues through 2032

Colorado extends commodity handler and farm-product licensing and oversight for seven years, from September 1, 2025, to September 1, 2032. The program must undergo a sunset review before its scheduled repeal. Civil penalties collected under the law go to the state General Fund instead of the Inspection and Consumer Services Cash Fund.
