Fuel sellers face fines with defenses

The law applies when the federal Environmental Protection Agency requires reformulated gasoline in Colorado areas that fail air-quality standards. The state's Division of Oil and Public Safety director can fine retail distribution that breaks the required fuel-quality standard. Fines can reach $5,000 for each day a violation occurs. Retailers and licensed fuel distributors have a defense if they relied on transfer documents clearly showing the fuel met that standard. This applies to violations on or after the law's effective date, which the source does not state.
