Court rules change for family cases

Family Court alone handles nonfelony offenses between separated people who share a child when parentage is not disputed. When parentage is disputed, Family Court and the Court of Common Pleas can both hear the case. The Court of Common Pleas also shares authority over adult Family Court cases that qualify to be combined with its cases. That adult-case rule excludes felonies. These rules change which court hears a case, not criminal penalties.

Family Court ties cross state lines

Listed family relationships now count for Delaware Family Court even when one or both people live outside Delaware. The definition includes listed blood, marriage, step, and adoptive relationships, as well as specified cohabiting relationships. Blood relationships count regardless of whether the parents were married. This changes which cases fall under Family Court, not household payments or benefits.
