Simpler death benefit claims for Delaware families

Delaware's Insurance Commissioner can decide uncontested Line-of-Duty Death Fund claims from submitted documents, without a hearing. Contested claims require a hearing, where claimants can have a lawyer. For every claim, the Commissioner must review evidence, make findings, and explain the decision and reasons in writing. The Commissioner can require witnesses and records, administer oaths, and must keep written or recorded testimony. The Commissioner can also set rules for submitting, processing, and deciding claims, including hearing rules.
