People gain remedies for illegal searches
If a Delaware government entity illegally obtains your identifying information through a reverse search, it must give you written notice. The notice must explain the violation and your legal options. You can sue the entity and seek $1,000 per violation or actual damages, whichever is greater. Courts can also order action, declare your rights, or award extra damages to punish violations, considering their scope, targeting, and persistence. Winning plaintiffs must receive reasonable attorney fees.
Delaware bans broad searches identifying people
Delaware state and local agencies cannot use reverse searches to identify unnamed people by search terms, website visits, or location. The ban covers court orders, voluntary requests, purchases, and access to information obtained through these searches. Courts and agencies cannot issue, support, or enforce these orders or requests, including court orders from elsewhere. Agencies also cannot get barred information through federal or out-of-state agencies. Evidence obtained illegally, or found because of it, cannot be used in criminal, civil, or administrative proceedings, except to prove a violation. This includes evidence later obtained another way or that might otherwise have been discovered.
