Civil arrest protections for Delaware court visitors

Delaware law protects people from civil arrest while going to, staying at, or returning from court for a judicial matter. It also protects parties, witnesses, attorneys, and observers participating in or attending court proceedings. Covered courthouses include buildings where state court proceedings take place or court officers or employees work. Protection extends to courthouse grounds, parking areas, and immediate surroundings. Criminal-law arrests and arrests authorized by a judicial order are not covered. Judicial officers can stop activities that threaten court access or disrupt court operations, including violations of this protection. People arrested or detained unlawfully can ask a court to review their detention through habeas corpus. Knowing violators may owe damages for false imprisonment, and courts may award winning parties attorney’s fees and costs.
