Delaware bans for-profit detention facilities
Delaware bans private, for-profit operators from running detention facilities under government contracts or agreements. The ban covers confinement to serve a court-imposed punishment or await a trial, hearing, or court or agency proceeding. Six types of facilities are exempt. These include facilities providing rehabilitation, counseling, treatment, mental health, education, or medical services to juveniles under Family Court authority. Facilities providing evaluation or treatment under Delaware's court commitment law are also exempt. Another exemption covers facilities providing education, job training, medical care, or support services to inmates under direct corrections or law-enforcement supervision. The remaining exemptions cover licensed residential-care facilities, school disciplinary detention, and public-health quarantine or isolation facilities.
