Delaware's criminal impersonation law now covers federal officers and agents with power to make arrests under federal law. It covers pretending to be an officer or creating or reinforcing that false impression without lawful authority. The person must intend to help commit a crime or be fleeing immediately from one. Existing coverage of police officers, firefighters, emergency medical technicians, paramedics, and fire police remains. The offense remains a class E felony in general. It becomes a class C felony if the impersonator or another participant physically injures a nonparticipant during the crime or immediate escape. The same higher penalty applies if either commits a class A or B felony or a sexual offense during that time. Separate charges, convictions, and sentences for other crimes remain allowed.
